TERMS & CONDITIONS

PRINCIPLE MOVEMENTS PTY LTD
 

These Terms & Conditions (“Terms”) apply to all services, memberships, bookings, passes, programs, workshops, events, and Independent Personal Practice sessions provided by Principle Movements Pty Ltd (“Principle Movements”, “we”, “our”, “us”).
 

By purchasing, booking, attending, or participating in any service provided by Principle Movements Pty Ltd, you acknowledge that you have read, understood, and agree to be bound by these Terms.
 

1. SERVICES

Principle Movements Pty Ltd provides:

  • Pilates classes;

  • Clinical Pilates sessions;

  • Private and semi-private sessions;

  • Workshops and events;

  • Studio access for Independent Personal Practice (“Self-Practice” or “Joe’s Gym”); and

  • Studio space for independent instructors, therapists, and practitioners to provide services including workshops, treatments, and related offerings.

Principle Movements reserves the right to modify, cancel, reschedule, substitute, or discontinue any class, instructor, session, timetable, membership, service, or offering at any time without liability. We endeavour to give you as much notice of changes as we can. Please check live timetables for up-to-date information on all classes and events

2. BOOKINGS & PASSES

2.1 All classes and sessions must be booked through the designated booking platform.

2.2 All passes, memberships, introductory offers, packs, and services are:

  • non-refundable;

  • non-transferable; and

  • not redeemable for cash.

2.3 Passes expire six (6) months from the date of purchase unless otherwise specified.

2.4 Introductory offers are limited to one per person and are available to new, local Whitsunday based residents only.

2.5 Passes purchased online will activate upon your first visit.

2.6 Principle Movements reserves the right to refuse bookings or attendance at its discretion.

3. CANCELLATION POLICY

3.1 A minimum of six (6) hours’ notice is required to cancel or reschedule any class, appointment or session. Independent Personal Practice booking have a minimum of two (2) hours’ notice to cancel or reschedule a session.

3.2 Late cancellations made within the minimum cancellation time of the scheduled start time will:

  • result in forfeiture of the session or class pass; or

  • incur a cancellation fee of $25 for membership holders.

3.3 Failure to attend a booked session (“No Show”) will:

  • result in forfeiture of the session or class pass; or

  • incur a cancellation fee of $25 for membership holders.

3.4 Cancellations must be made via the approved booking platform only.

3.5 Repeated late cancellations or no-shows may result in suspension or termination of memberships or studio access.

4. MEMBERSHIPS

4.1 Memberships operate on a recurring weekly direct debit basis unless stated otherwise.

4.2 Memberships are subject to a minimum commitment period of three (3) months unless otherwise specified.

4.3 Memberships will continue indefinitely unless terminated in accordance with these Terms.

4.4 By purchasing a membership, you authorise Principle Movements and its payment provider to debit your nominated payment method for all applicable fees and charges.

4.5 Failed or dishonoured payments may incur a dishonour fee of $10.

4.6 Principle Movements reserves the right to increase pricing upon providing at least four (4) weeks written notice.

5. MEMBERSHIP PAUSES & CANCELLATIONS

5.1 A minimum of two (2) weeks written notice is required for all pause requests.

5.2 Membership pauses must be for a minimum period of two (2) weeks.

5.3 A minimum of two (2) weeks written notice is required to cancel a membership. Two further scheduled payments will apply following notice of cancellation.

5.4 Membership cancellation requests cannot be processed during an active suspension or pause period.

5.5 Immediate termination may be permitted where a medical condition permanently or significantly prevents participation, supported by written medical evidence.

5.6 No refunds will be provided for unused services, sessions, memberships, or passes.

6. INDEPENDENT PERSONAL PRACTICE (“JOE’S GYM”)

6.1 Nature of Service

Independent Personal Practice sessions are self-directed sessions allowing clients to access studio equipment independently.

These sessions are not instructor-led classes.

While staff may be present within the studio during these times, staff are present solely for operational purposes and are not responsible for:

  • supervising clients;

  • providing instruction or corrections;

  • prescribing exercises; or

  • ensuring client safety during participation.

Clients acknowledge that they participate independently and entirely at their own risk.

6.2 Eligibility

Participation in Independent Personal Practice is limited to clients who:

  • have prior Pilates experience; and

  • are confident in using the equipment safely and independently.

Principle Movements may require completion of:

  • beginner classes;

  • private sessions;

  • introductory sessions; or

  • apparatus preparation sessions

prior to granting access.

Principle Movements reserves the right to refuse, suspend, or revoke access to Independent Personal Practice at any time.

6.3 Client Responsibilities

Clients participating in Independent Personal Practice agree that they:

  • are solely responsible for their own exercise selection and participation;

  • will only perform exercises they have previously been taught;

  • will not attempt unfamiliar, advanced, or unsafe exercises;

  • will use all equipment safely and correctly;

  • will immediately stop participation if experiencing pain, dizziness, discomfort, or injury; and

  • will report any faulty equipment, hazards, or incidents immediately.

Clients acknowledge that they are participating without supervision or instruction.

6.4 Equipment & Studio Conduct

Clients agree to:

  • respect all studio rules and staff directions;

  • clean and return equipment after use;

  • vacate the studio promptly at the end of their booking; and

  • behave respectfully toward staff, contractors, and other clients.

Unsafe, disruptive, offensive, inappropriate, or reckless behaviour may result in immediate removal from the premises and termination of access without refund.

7. PRIVATE SESSIONS

7.1 Private sessions require a minimum of six (6) hours’ notice for cancellation or rescheduling.

7.2 Late cancellations and no-shows will incur the full session fee.

8. HEALTH & MEDICAL CONDITIONS

8.1 Clients warrant that they are medically and physically fit to participate in classes, sessions, or Independent Personal Practice.

8.2 Clients agree to disclose any injuries, illnesses, medical conditions, pregnancy, or physical limitations that may affect participation.

8.3 Principle Movements recommends that clients seek medical clearance prior to commencing exercise programs where appropriate.

8.4 Participation remains entirely at the client’s own risk.

9. ASSUMPTION OF RISK & WAIVER

9.1 Clients acknowledge that participation in Pilates, fitness activities, and use of studio equipment carries inherent risks including, but not limited to:

  • physical injury;

  • aggravation of existing conditions;

  • illness;

  • permanent disability; and

  • death.

9.2 Clients voluntarily assume all risks associated with participation in any service or activity provided by Principle Movements.

9.3 To the fullest extent permitted by law, Principle Movements Pty Ltd, its directors, employees, contractors, instructors, therapists, and agents are excluded from all liability for:

  • injury;

  • loss;

  • damage;

  • illness;

  • death; or

  • any claim arising from participation in services or use of facilities.

9.4 To the fullest extent permitted by law, Principle Movements Pty Ltd limits its liability for any claim arising from participation in Pilates Exercises to the re-supply of the services or the cost of re-supplying the services.

9.5 Clients release and indemnify Principle Movements Pty Ltd against all claims, actions, damages, costs, losses, and expenses arising directly or indirectly from participation in any service or activity.

10. PERSONAL BELONGINGS

Principle Movements is not responsible for loss, theft, or damage to personal belongings brought onto the premises.

11. PRIVACY

11.1 Principle Movements collects and stores personal and health information for the purpose of providing services safely and effectively.

11.2 Personal information may include:

  • contact details;

  • emergency contact details;

  • health information;

  • payment information; and

  • booking history.

11.3 Principle Movements will not sell personal information to third parties.

11.4 Information may be used for:

  • service delivery;

  • account management;

  • communication;

  • marketing;

  • promotional offers; and

  • business improvement purposes.

11.5 Clients may opt out of marketing communications at any time.

11.6 Principle Movements will take reasonable steps to protect personal information in accordance with applicable privacy laws.

12. WEBSITE & DIGITAL CONTENT

12.1 All website content remains the property of Principle Movements Pty Ltd unless otherwise stated.

12.2 Content may not be copied, reproduced, distributed, or used without prior written permission.

12.3 Use of the website constitutes acceptance of these Terms.

13. RIGHT TO REFUSE SERVICE

Principle Movements reserves the right to refuse entry, participation, membership, or service to any person at its absolute discretion.

14. GOVERNING LAW

These Terms are governed by the laws of Queensland, Australia.

15. ACCEPTANCE

By booking, purchasing, attending, or participating in any service offered by Principle Movements Pty Ltd, you acknowledge and agree that:

  • you have read and understood these Terms & Conditions;

  • you voluntarily accept all risks associated with participation; and

  • you agree to be legally bound by these Terms.
